Appeals court backs developers in Natomas Basin fight

Described as the last "dark cloud" in the Natomas Basin where development clashed with the Swainson hawk and the giant garter snake, a Sacramento-based appeal court Monday rejected an attack on the validity of environmental impact reports.
"Development may proceed notwithstanding adverse impacts on endangered populations so long as the California Endangered Species Act and the California Environmental Quality Act are complied with," the 42-page decision of the 3rd District Court of Appeal read.
The attack upon ongoing development, which was launched by environmental groups, would have brought a halt to massive commercial and residential development in the 53,537-acre basin, said Gregory Thatch, a lawyer who represented several developers.
